I.    GENERAL

The following General Conditions determine the terms and conditions under which the www.EventLobster.com offers the online quotation and booking service for vendors and registered members, the navigation through the website and use the services provided without Membership registration (e.g. information services, etc. from now on mentioned as “other services”), and constitute the legally binding terms between Eventlobster.com and visitors /registered members regarding the online quotation and booking services for vendors registered in the system and other services provided by the Eventlobster.com through the website. These terms and conditions apply as above defined, whatever electronic medium may be used by visitors and members for their access to the Service and other services offered by www.Eventlobster.com.

By accessing and browsing the site by the visitor and /or during registration of Users and vendors as members at the EventLobster.com services, it is considered that those General Terms have been read, understood and unconditionally accepted by the visitor, User and Vendors as legally represented (including the Privacy Policy and the Policy Accepted Purpose).

If the visitor / user / Vendor disagree with any term and /or all of these terms, please do not use any of the services provided by Eventlobster.com in www.Eventlobster.com. Any use of such services or of some of them implies the unconditional acceptance and compliance on the part of these General Conditions and each time entering the www.Eventlobster.com users reaffirm their agreement with Eventlobster.com with these General Terms.

Note that Eventlobster.com may from time to time to modify or replace the entire and / or part of these General Terms in its sole discretion and /or when the modification / replacement are required by law, without prior notice. Any changes will be valid from the date posted on to the site. Visitors and members will be notified for any modification of these General Terms, upon entering the site, so the continuation of navigation and /or use of services of www.Eventlobster.com from those individuals involves an automatic and unconditional acceptance of the modified General Conditions on their behalf. If anyone does not agree with the changes must not take any action or use www.Eventlobster.com services and Members have the right to request the deletion of their account or their removal from the emailing list by following the procedures described herein.

By using any service of Eventlobster.com, the members / visitors agree that any claims against any third party or Member for any actions and /or omissions, is limited to those persons and no liability is attributable to Eventlobster.com for any actions /omissions of such persons.

THE ACCEPTANCE OF THESE TERMS IN ACCORDANCE WITH THE ABOVE MEMBERS AND VISITORS EXPRESSLY DECLARE THAT THEY HAVE THE LEGAL AGE THAT ALLOWS THE COMMITMENT FROM THESE GENERAL CONDITIONS.

II.   TERMS AND INTERPRETATION

Notwithstanding the terms and definitions given in these General Terms, further definitions apply as per below:

Representative data:
The personal data of the legal representative of the Vendor (name, surname, email address).

Vendor Details:
The data provided by the Vendor representative during enrolling in the service, the trade name, the home address (street name and number, ZIP, Region), the telephone numbers, the contact names and the availability.

User data:
The personal data that the User declares and grants to EventLobster.com during new member registration process (first and last name, valid email address, region, telephone).
Management tool:
The Account Management system, Profiles and other services provided by the EventLobster.com to the vendores and to the users during their registration.
Website:
The website www.EventLobster.com or any other websites hosted in the future at the sole discretion of EventLobster.com.
Authorized User:
The natural person who acts on behalf of the Member’s registration and / or use of the Service.
Visitor:
Any person who navigates through the site and / or makes use of other services provided by the site EventLobster.com for the use of which no Member registration is required.
Vendor:
Is considered the entity entering the service provided and opens an account at www.EventLobster.com in order to display in the platform his services and utilize the tools the platform is offering.
Member Account:
The Account is automatically opened by the EventLobster.com upon completion of membership registration to the Service and which is accessible through the Members of passwords to manage their data.
Member:
Users are considered and the vendors, as defined herein.
Profile Vendor:
The page of the Vendor in the website that displays information of the Vendor.
User Information:
All information and data of the user recorded by EventLobster.com during the inter-action with the Platform (including without limitation the information displayed in their profiles – Applications to vendors, communication, etc.) and other services including simple navigation in the website (including online behavioral data of the user or data taken from the Cookies and EventLobster.com treats according to the Cookies policy).
Application Details:
Name, Surname, date of application, User Mobile Phone, P.O., country, email and password.
Service:
The electronic quotation and booking service and all other electronic applications offered by EventLobster.com.
Services (Other):
Any service EventLobster.com can provide to the visitors and / or members of the Service, without the need for a registration of such persons to the system, indicatively information service etc.
User:
Considered the person who has entered the EventLobster.com services provided on the website and opened an account at www.EventLobster.com, in order to make use of the services provided through the EventLobster.com Platform.

The Policy of Accepted Uses and the Privacy Policy constitute an integral part of these General Terms.

The headings of the Articles of the General Conditions are not restrictive for their interpretation.

Any reference or definition in words that are in the singular form, shall also include the plural form of them.

III.  REGISTERED MEMBERS

1.      Scope

The registration of both citizens and vendors (or representatives of vendors) to the services offered is a prerequisite in order for vendors to build their profile on the platform and display relevant information related to them, and on the other hand, to allow users to make use of the Online RFQ and booking service. Registration and membership is free, personal, non-transferable and non-assignable. Members are responsible for data handed over and EventLobster.com is solely based on their statements regarding the data and their validity. Personal data Members grand upon registration as a Member, are treated by EventLobster.com according to the terms and provisions of these General Terms and the Privacy Policy.

2.    User registration process

2.1.    User Registration

Registration of the User as a member in the EventLobster.com Service is necessary in order to make use of the services. The registration process is quick and simple and the system will guide him automatically to the registration tab of a New Member after trying to contact a vendor while not registered. Alternatively, the user is led to the New member registration form “by clicking” to “register” tab on the front page of the website.

For the User registration it is required to administer the following personal data: name and surname, email address (email), and password and the acceptance of these General Terms of Use, and the Civil Protection Privacy of EventLobster.com.

More information regarding the type, the purpose of the data processing, the recipients of the data and the Members’/ Users’ rights are contained in the Privacy Policy of the EventLobster.com.

By submitting the registration form, EventLobster.com will send an email to the declared by the user email in his registration request, which asks for a confirmation for the registration. Only the confirmation of registration in accordance with the instructions provided in confirmation message (email) completes the registration of the User on the EventLobster.com Service.

Upon completion of the registration of the User in accordance with the above, EventLobster.com opens to the User his account.

2.2.    Vendor Registration

The registration of the Vendor in the Eventlobster.com Service is a prerequisite for using the services. The process is easy, quick and free. The Vendor should submit to Eventlobster.com a registration form or to communicate by email with the communication details listed. The Registration is completed by the vendor and the details required are the following: user name, first and last name, email and password. The Eventlobster.com team has the right to communicate with the vendor in order to validate his details.

2.3.    User Account

Upon the completion of the registration in the Eventlobster.com Service, the User / Vendor acquire the status of a Member. As Members they acquire an Account at Eventlobster.com, where their data and the data they provided during the registration process are stored. The data and information entered during registration must be complete, true and updated. In case any Member wishes to change some of his declared data, he shall enter his Account and store the new data /elements.

According to the above and with the member registration, the explicit consent is given for the collection and processing of data and information on the basis of these General Terms and the Privacy Policy of the Eventlobster.com, which Terms and Policies are considered read, understood and fully and unreservedly accepted. The member can withdraw his consent to the collection and processing of data, which the Member has granted in accordance with the above, either through Member deletion, or by sending an appropriate message on the Eventlobster team at eventlobster@gmail.com. The Member has access to his account anytime, and may request immediate deletion or correction of his data (if this is not accomplished through his account), temporary non-use of his data by georgep31.sg-host.com, freezing or non-transmission of his data, by sending a request to eventlobster@gmail.com. In any case the Member’s data are kept by Eventlobster.com only for as long as he remains a registered member of Eventlobster.com, with the express reservation as expressly provided in these Terms and Conditions. The User data will not be communicated to any third party for any purpose other than the purpose clearly defined in these Terms and Conditions and the Privacy Policy. If the Member wishes to delete the account, he will have to send to Eventlobster.com a relevant request to georgep31.sg-host.com@gmail.com address in writing. The EventLobster.com will take all the steps necessary to delete the account of the member as soon as possible and at the latest within 48 hours (due to technical issues).

2.4.    User Profile

By registering as a member of the Service, a profile of the user is automatically created at the platform. There the user can monitor the list of applications, quotes and communications exchanged with the vendor. In the User profile information regarding the use and the actions with the service is stored. The User may upload to his profile photos on his own responsibility.

2.5.    Vendor Profile

Upon completion of the registration of the Vendor and the Account activation, the possibility is provided to the Vendor to create a profile, i.e. a page in the platform on which she can present information. In particular, the Vendor can post information regarding activities, contact details, photographic material of his performed work etc.

IV.  THE SERVICE (ONLINE REQUEST, QUOTATIONS, BOOKINGS AND MANAGEMENT)

1.   Scope

Through the website we (Eventlobster.com and its affiliate/ distribution partners) provide an online platform through which all types vendors related with events (for example, hotels, venues, photographers, videographers, Djs, promoters, decorations, wedding areas, catering, bartenders etc., collectively the “vendors”), can advertise their services, and through which visitors to the website can make request and receive quotation for their services, which can be booked at a later stage. By making a booking through Eventlobster.com, you enter into a direct (legally binding) contractual relationship with the vendor at which you book. From the point at which you make your reservation, we act solely as an intermediary between you and the vendor, transmitting the details of your requests to the relevant service provider and sending you a confirmation email for and on behalf of the vendor.

When rendering our services, the information that we disclose is based on the information provided to us by vendors. As such, the vendors are given access to an extranet through which they are fully responsible for updating details, availability and other information which is displayed on our website. Although we will use reasonable skill and care in performing our services we will not verify if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any temporary and/or partial breakdown, repair, upgrade or maintenance of our website or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Each vendor remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including the rates and availability) displayed on our website. Our website does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level, qualification or (star) rating of any vendor made available.

Our services are made available for personal and non-commercial use only. Therefore, you are not allowed to re-sell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content or information, software, products or services available on our website for any commercial or competitive activity or purpose.

2.   Conditions of use of the Application Services

Prerequisite for using the Services of Eventlobster.com is the registration of the User and the Vendor as a member in www.georgep31.sg-host.com and unconditional acceptance of these General Terms and the Privacy Policy.

3.   Process, Application Terms and Conditions

The user is provided with tools to seek the Vendor that may interest him and can also add additional search filters such as area, available dates, etc. A list of available Vendors is presented to the User, who then has the opportunity to receive as many information as possible concerning the Vendor. In any case, the User can see all the available vendor details and electronically request a quotation for his event.

To complete the booking process, the User should accept one of the received quotations submitted by the vendor and the vendor should also verify form his side that he will undertake the job.

Proceeding with a booking with a Vendor, the User accepts and agrees with any additional terms and conditions this Vendor may have.

Since the booking of vendor services is made by the User in accordance with the above, Eventlobster.com undertakes to send automatic notification to the Vendor, forwarding the application data and the user data i.e. name, surname, telephone number, date of application, general information provided by the user, in order to inform the vendor for the event details. Eventlobster.com is not responsible for the accuracy of the data of the application, including the User data.

Once the booking is completed as per the instructions mentioned herein, Eventlobster.com has no obligation neither towards the Vendor nor the User, as it solely operates as an intermediary between them.

4.   Cancellation Policy – Changes

By making a reservation with a vendor, you accept and agree to the relevant cancellation policy of that vendor, and to any additional (delivery) terms and conditions of the vendor that may apply to your reservation or during your event, including for services rendered and/or products offered by the vendor (the delivery terms and conditions of a vendor can be obtained with the relevant vendor). Please note that special offers by vendors could be excluded from any cancellation or change, depending on the vendor requirements. Please check details thoroughly for any such conditions prior to making your reservation.

The User may cancel his booking. Before User cancels his request, he would be kindly requested to contact the Vendor and report the cancellation. Also, during the cancellation process the user will be requested to provide a reasoning of the cancellation. Any cancellation consequences will be governed by the cancellation policy of each vendor.

The Vendor may also cancel a confirmed booking. Before Vendor cancels his request, he would be kindly requested to contact the User and report the cancellation. Also, during the cancellation process the Vendor will be requested to provide reasoning for the cancellation.

5.   Vendor Ranking & reviews

Eventlobster.com is not favoring, promoting or indicating any of the Vendors. The available photos and texts accompanying the vendors and the services provided are intended solely to describe them and under no circumstances should those be considered as suggestions by the EventLobster.com.

The order, in which Vendors and their services appear in the platform, is determined automatically and unilaterally by Eventlobster.com. More indicatively, the display order is based on and influenced by an algorithm developed by Eventlobster.com. In the event however that the User has set search filters based on the area or the available date, the platform reads on Google’s center and displays the nearest, or the available ones. Eventlobster.com reserves the right to unilaterally alter the listing of Vendors informing Members with related post on the website, as defined in these General Conditions regarding the amendment of the present.

The completed vendor assessment may be (a) uploaded onto the relevant vendor’s information page on our website for the sole purpose of informing (future) customers of your opinion of the service (level) and quality of the vendor, and (b) (wholly or partly) used and placed by EventLobster.com at its sole discretion (e.g. for marketing, promotion or improvement of our service) on our website or such social media platforms, newsletters, special promotions, apps or other channels owned, hosted, used or controlled by EventLobster.com and our business partners. We reserve the right to adjust, refuse or remove reviews at our sole discretion. The guest review form should be regarded as a survey and does not include any (further commercial) offers, invitations or incentives whatsoever.

V.   LEGAL STATUS OF EVENTLOBSTER.COM

1.   General

Eventlobster.com is associated with an event booking and quotation platform. People interested to organize their event, will be able to go through the registered event professional profiles (photographers, DJ, venue places etc.) and request quotations/proposals for their event. All these users will have an account and all their requests will be managed at their accounts. On the other side, all vendors will also have an account, from where they will be able to manage their requests (accept or not to proceed with a quotation/proposal to the user), create online proposals or upload existing proposals to the system, create bookings and also manage and update their public profile.

2.   Rights – Obligations of Eventlobster.com

2.1.   Permanent deletion of member account

In addition to the cases mentioned in these General Conditions regarding deleting Member Account, the company expressly reserves the right to cancel any membership for the following cases: a) If the Member violates the policy of proper use of the Service, and / or violates any term or condition stated in these General Terms and / or has committed any criminal or other offense against the use of the Service and / or has caused a direct risk to EventLobster.com and / or any Member, and / or for any other good reason not listed herein.

In these cases the deletion of the account will be direct and automatic, without the company entitling the Member to remedy the violation, expressly reserves all legal rights including the right to restore any damage it has suffered from any of the acts and /or omissions of Members in accordance with the above.

2.2.   Temporary disabling of the service

In addition to the cases mentioned in these General Terms regarding deleting a Member Account, Eventlobster.com expressly reserves the right in its sole discretion to temporarily disable the User Account immediately and without penalty, if he deems that the User has violated any term described herein and until cancelling the breach at his sole discretion. In case of non-compliance, Eventlobster.com may permanently disable the account of the Member, expressly reserving all the legal rights, including the right to rehabilitate for any damage that has been caused by any of the acts and /or omissions of the User in accordance with the above.

It is expressly agreed that for cases described at Articles 2.1 and 2.2, the member has no right to demand the rectification of any damage occurred due to the deactivation of the Service in accordance with these provisions, even if the information on which Eventlobster.com has based his decision to delete the  Account was wrong, as he recognizes and accepts that the automated tools used by Eventlobster.com for identifying any illegal or unconventional activities of Members, are based on general standardized /automated software commands.

It is understood that the Member who has been deleted from the Service, will not be accepted to join the Service again with the same or other credentials unless Eventlobster.com expressly consented to this. For this reason, the Member agrees Eventlobster.com to maintain the personal details into the system in order to be able to identify any subsequent registration attempt.

2.3.   Service Closure

Eventlobster.com reserves the right for technical, maintenance and / or upgrading of the Platform and / or the Services reasons, to interrupt the operation of the Service temporarily and at regular intervals. If the interruption lasts more than a reasonable time at the sole discretion of Eventlobster.com, or has already been determined by the interruption, Eventlobster.com will inform Members with relevant posting to the site. It is expressly agreed that members cannot raise claims against Eventlobster.com for any damage suffered even if  Eventlobster.com in its sole discretion does not notify such withdrawal.

Additionally of those expressly provided herein, Eventlobster.com may at any time terminate, change, suspend or discontinue any specific features of the Service, including the availability of the Service itself, with or without notice.

2.4.   Provision of Information

Eventlobster.com, if requested by the competent prosecuting, supervisory, judicial or other authority, is required to transmit the data of Users and / or the Vendors, including any personal data supplied to the Eventlobster.com under terms stated herein, data and any other information provided to it, without prior notice or consent of such persons for the necessary protection against risks to state and public security and for the prosecution of crimes, including tax crimes and offenses.

3.     Limitations of guarantees and liabilities

Eventlobster.com always acts in good faith and in the context of what is stipulated by law and the present General Conditions. Therefore it has received and continues uninterrupted to take all the necessary technical or other measures and make every effort in order the (a) Service to operate continuously and properly without any problems, interruptions, delays, errors or mistakes, (b) the technology used by the Eventlobster.com or the servers through which the Service is made available to Users and the Vendors do not contain viruses or other harmful components, however OFFERS NO WARRANTIES REGARDING all the above.

Furthermore, Eventlobster.com offers no guarantee for (a) the relevance, effectiveness, efficiency of the Service regarding the purpose for which the User or the Vendor uses the system (b) proper and adequate execution of transactional obligations of Users and vendors regarding the provision of services from the second to the first and obligations arising from these services.

The Service is provided “as is” and in a manner fully automated and does not include the introduction of any component in the system or configurations on an ad hoc basis. The Service may be revised, or updated in the future at the sole discretion of Eventlobster.com.

Eventlobster.com takes all necessary technical and other measures to ensure that users and vendors comply with these terms and the applicable legislation, but as a Service Provider of the Information Society has no obligation under the Law to (a) control information provided, (b) actively to seek facts or circumstances indicating that a member has made unlawful or unconventional activities while using the service, (c) actively seek the authorization given by a User to an Authorized User, or the legitimation of Authorized Users regarding the acts and / or omissions by using the Service on behalf of Users or Vendors, (d) monitoring the compliance of Users and Vendors during their interactions and application of tax legislation, legislation concerning the protection of personal data, consumer protection or other applicable laws and rules.

4.   Limitation of Liability

Additionally to what has been expressly provided herein, Eventlobster.com bears no responsibility related with civil, criminal, against the User, the Authorized User, the Vendors, their Partner and /or any third party having rights from them, if any from above, by using the Service gets harmed either direct, indirect, consequential, profit, income, reputation related, or suffer any other damage direct, indirect or consequential, economic or of any other nature, loss of profits, due to:

(A) Delayed or inadequate dispatch, transmission, storing, downloading any information or Content, and /or loss or destruction of these, because of errors, omissions, technical errors, defects or malfunctions of telecommunications networks, the Internet, the website, the Internet Service Providers.

(B) Any permanent or temporary deactivation of the Service, shutdown of all of the Service or individual functions, deleting Member Account or technical jamming of the Service as set out herein.

(C) Events, conditions, actions, acts and /or omissions of Eventlobster.com or third parties including members for which Eventlobster.com offers no warranties and bears no liability as defined herein.

(D) Use by vendors or other 3rd parties of Users’ data (including any personal data) for purposes other than the use of the Service.

(E) Violation of applicable tax or other laws that is related to the use of the Service.

(F) Any discrepancy of the Service Time to a time that has been formally established.

(G) force majeure events.

Any complaints or requirements (regarding products or services offered or provided) or special requests of the Users should be managed by the Vendors, without any mediation or interference from Eventlobster.com. Eventlobster.com bears no responsibility and disclaims all liability regarding the requirements of the Users during their interaction with the Vendor.

In any case it is expressly agreed that the Eventlobster.com is liable only for direct losses deriving from willful misconduct or gross negligence on his part. Subject to mandatory law, expressly excludes liability of EventLobster.com for direct damage due to slight negligence irrespective of the legal ground. It is excluded fully and explicitly the responsibility of EventLobster.com for incidental or consequential damages, for whatever reason.

THE LIMITATIONS SET FORTH HEREIN TO REMEDY SHALL APPLY EVEN IF PRESENT CONDITIONS HAVE NOT BEEN SATISFIED OR ARE CONSIDERED INVALID OR UNENFORCEABLE AND USER ACKNOWLEDGES THAT THESE LIMITATIONS ARE LOGIC AND ARE FORMING THE BASIS OF THIS AND THAT WITHOUT THESE RESTRICTIONS COMPANY WOULD NOT JOIN THE TERMS AND CONDITIONS.

However, to the extent permitted by law, neither Eventlobster.com nor any of its officers, directors, agents, affiliated companies, distributors, online affiliates, licensees, agents or others involved in creating, sponsoring, promoting or in any other way to provide the Service, Eventlobster.com is not responsible for (i) any punitive, special, indirect or consequential loss or damage, any loss of production, loss of profit, loss of revenue, loss of contract , loss or damage to goodwill or reputation, compensation loss, (ii) any ambiguity about the information (description) of the Vendor (including availability) provided in the platform, (iii) any (direct, indirect, consequential or punitive) damages , losses or charges which the User suffered, paid or caused, according to, following or in connection with the use, inability to use or delay in use of the website, or (iv) for any (personal) injury, death , personal property damage, or other (direct, indirect, special, consequential or punishable) damages, losses or charges which the User suffered, paid or caused either due to (legal) acts, errors, breaches.

Although Eventlobster.com does every effort to verify the information provided in the Platform, can neither confirm nor guarantee that all information is accurate, complete or correct, nor can be held responsible for any errors (including manifest and typographical errors) for interference (temporary and / or partial) breakdown, repair work, upgrading or maintenance of the website or from any other cause), inaccurate, misleading or untrue information or non-delivery of information.

By uploading photos/images onto our system (for instance in addition to a review) members certify, warrant and agree that they own the copyright to the photos/images and that they agree that Eventlobster.com may use the uploaded photos/images on its (mobile) website and app, and in (online/offline) promotional materials and publications and as Eventlobster.com at its discretion sees fit. Members are granting Eventlobster.com a non-exclusive, worldwide, irrevocable, unconditional, perpetual right and license to use, reproduce, display, distribute, sublicense, communicate and make available the photos/images as Eventlobster.com at its discretion sees fit. By uploading these photos/images the person uploading the picture(s) accepts full legal and moral responsibility of any and all legal claims that are made by any third parties (including, but not limited to, vendors) due to Eventlobster.com publishing and using these photos/images. Eventlobster.com does not own or endorse the photos/images that are uploaded. The truthfulness, validity and right to use of all photos/images is assumed by the person who uploaded the photo, and is not the responsibility of Eventlobster.com. Eventlobster.com disclaims all responsibility and liability for the pictures posted. The person who uploaded the photo warrants that the photos/images shall not contain any viruses, Trojan horses or infected files and shall not contain any pornographic, illegal, obscene, insulting, objectionable or inappropriate material and does not infringe any third party (intellectual property right, copyright or privacy) rights. Any photo/image that does not meet the aforesaid criteria will not be posted and/or can be removed/deleted by Eventlobster.com at any time and without prior notice.

VI.  MEMBERS OBLIGATIONS

1.   General

Members are obliged to keep the password to the Service secret and do not disclose it to any third party without the relevant license for the Service on their behalf. If the Member considers that the password is stolen or revealed to a third party without permission, he must change it, otherwise he is solely responsible for the acts or omissions of the Platform.

Members must respect the intellectual property rights of third parties, their personal data and their personality and not to infringe those by annotating comments, information and generally with their acts and / or omissions towards the Service.

It is expressly agreed that the Members are solely responsible for the legality and correctness of the information and data provided to Eventlobster.com during the registration process or use of the Service. Members explicitly and unconditionally agree and guarantee that:

Have read and understood these Terms, the Privacy Policy, the Policy of Agreed Terms and any other policies and accepts them fully and unconditionally.

If a third party is acting in the name and on their behalf (authorized user) that has received all the necessary permits for the administration of the Member’s data, records and information relating to them, including consents in accordance with applicable legislation for the protection of personal data of the subjects.

At their own risk and expense to take immediately all necessary measures and in any case will reimburse in full Eventlobster.com, from any claim, loss, damage, costs, expenses obligations, responsibilities, variations penalties, fines, legal fees that these persons might suffer as a result of (a) any breach on their part of these General Terms, declarations and their guarantees under the present copyright or other rights of Eventlobster.com (b) any other action or omission when using the service and / or other services considered illegal.

2.   Members Specific Obligations

Each Vendor remains responsible at all times for the accuracy, completeness and correctness of the information (including availability) displayed on the profile of the platform.

Vendors make clear and undertake that the information will in all circumstances be true, accurate and not misleading and that it is in any case responsible for the correct and updated list of information.

With the opening of the Account, the Vendor has a right to access and use the management tool of Eventlobster.com, which enables the Vendor to manage calendar, applications (update, cancellation, confirmation) communication with Users, profile in (e.g. add, remove photos) etc. using the management tool of Eventlobster.com, should be in accordance with the Agreed Terms.

Eventlobster.com reserves the right to be advertised on various websites of their choice on the Internet and use partners or third-party advertising companies, as appropriate. Eventlobster.com hereby grants to the User and the Vendor the rights of access and use of the Service  and other services in accordance with these Terms. Eventlobster.com owns and retains possession and ownership of all right, title and interest (a) in the Platform and Services, the functions and features (including without limitation: the software, programs, philosophy, methodology and the technique used for designing the model of algorithms, information and materials of the Service and the software, including any amendments, setups of Service and the software and derivative operations, (b) the management tool for the Vendors, (c) the trade name Eventlobster.com, the site Eventlobster.com and derivatives, complex, or similar sounding names (d) in any other logos, trademarks and distinctive titles, trade secrets, patents and all other intellectual property rights with respect to the platform, the Service and the functions which become known to the User / Vendor through the Service.

All content on the website, such as text, graphics, logos, icons, images, audio clips etc., and software (“Content”), are the property of Eventlobster.com excluding the information provided by the Vendor, which are owned by the vendors apart from the reviews. Intellectual property rights included in training (i.e. presentation, selection, collection, arrangement, and assembly) of all the content on the website is the exclusive property of EventLobster.com that manages and operates it. The software, available in the platform, has copyright. Any use of the content and /or software that is not according with these Terms and the reproduction, modification, distribution, transmission, republication, display or performance of the website’s content is prohibited unless explicitly stated that is permitted.

Restrictions for permitting the access and use of the Service are referred to the Proper Use Act of the Service. The User grants Eventlobster.com the right to use any time aggregate statistical data elements, data and information of the User learned from using the Service, without the prior written consent of the User for its own commercial reasons. The User and respectively the Vendor retain all rights, title and interest in their data and their registration to the Service issue to Eventlobster.com the permission to use their data for the purpose of providing the Service, as described herein.

X.   FINAL PROVISIONS

1.   Final Terms

These General Terms are the final and unique conditions in force with respect to the provision of the Service from the Eventlobster.com to the User and remove any applied previously conditions, previous agreements and arrangements, written and oral between Eventlobster.com and the User regarding the use of the Service.

2.   Resignation

No delay, neglect or forbearance of the Eventlobster.com to enforce any term stated herein to the User does not constitute a waiver or damages any of the rights stated herein. If any term herein may be deemed by any competent court or authority to be invalid and thus unenforceable, this term will affect the validity of other remaining terms, which shall remain in full force.

3.   Nullity Terms

If any part of this is declared or designated by a court decision as invalid, the invalidity will not affect the validity of the remaining portion of the document, which will remain valid as these General Terms had been executed with the invalid portion already excluded. Eventlobster.com will seek to replace each invalid condition, with a new valid term, the outcome of which will constitute an equivalent of the one canceled.

4.   Applicable Law – Jurisdiction

Any dispute between the parties relating to the application, interpretation, nullity of the terms of the contract, the existence or absence of rights and obligations of the parties to a contract or tort, is construed in accordance with the Greek law and is subject to the exclusive jurisdiction of the eligible courts of the city of Athens, in the jurisdiction of which the parties are voluntarily submitted today.

    2.12 The introduction of the service, sending and transmission of information or programs – Software which may contain viruses or other damaging characteristics that can either cause malfunction of the Service, or cause exorbitant data traffic to the Service thus hindering its use by other Users.
    2.13 Use the Service in ways, which, regardless of feasibility (intent or negligence) might cause malfunction of the Service.
    2.14 This concession license, resell, lease, leasing, assignment, subcontracting and by any way granting of the Service to third parties for any use and purpose, except, of explicitly permitted uses thereof under this.
